What is Direct selling ?
Direct selling means selling goods or services directly to consumers, typically outside traditional retail stores — e.g., at home, through personal presentations, social media or online. Independent salespeople (called direct sellers) earn commissions on products they sell — and sometimes on sales by the people they recruit.
It includes multi-level marketing (MLM) when sellers earn from their own sales and from the sales of their recruited network, but direct selling ≠ pyramid scheme.
history of direct selling
📌 Early Days (1980s – 1990s)
Direct selling entered India in the 1980s. Early players included companies like Tupperware and others doing in-home selling.
📌 Liberalization & Growth (1990s Onward)
After India’s economic liberalization in 1991, many foreign direct selling companies set up in India — Amway, Avon, Oriflame — and Indian firms like Modicare also adopted the model.
📌 Regulatory Uncertainty (Pre-2016)
Before specific rules existed, direct selling firms were often wrongly targeted under the Prize Chits and Money Circulation Schemes (Banning) Act, 1978, which was intended to block pyramid/ponzi money circulation schemes — not direct sales. Many legitimate companies and sellers faced legal hassles because authorities misunderstood the business model.
📌 First Official Guidelines (2016)
In September 2016, the Direct Selling Guidelines 2016 were published to help State governments regulate direct selling, distinguish it from pyramid/ponzi schemes, and protect consumers.
📌 Stronger National Rules (2021–2022)
On December 28, 2021, the Consumer Protection (Direct Selling) Rules, 2021 were introduced under the Consumer Protection Act, 2019. These rules apply nationwide and clearly differentiate genuine direct selling from illegal pyramid/money circulation schemes.
In 2022, the Consumer Protection Act integrated direct selling into the law, strengthening its legal status.
Scams & Misuse in Direct Selling
Though the model itself is legal, fraudulent schemes and abuses are common — especially those that emphasize recruitment and promises of quick riches without genuine sales:
❗ Pyramid & Money Circulation Schemes
Pyramid schemes reward people mainly for recruiting, not selling products. These are illegal in India. The 2021 Rules specifically prohibit such schemes.
❗ High-Profile Cases
Some cases reported in India involve individuals being misled into paying large sums with promises of unrealistically high returns. For example, in 2025, a person in Hyderabad was allegedly duped of ₹26 lakh in an MLM-linked scheme promoted under QNet and Vihaan Direct Selling, leading to police cases. The Times of India
❗ Confusion & Misinterpretation
Law enforcement sometimes still misapplies older laws (like the PCMCS Act) to prosecute direct selling companies as money circulation schemes. This has caused legal friction even for established brands.
👉 Red flags to watch for
✔ Heavy focus on recruitment over product sales
✔ Pressure to pay upfront fees
✔ Unrealistic earning claims
✔ Lack of transparency about actual business/legal structure
Scammers often disguise pyramid schemes as direct selling. Always verify before joining or investing.
Indian Legal &
Government Framework
🧑⚖️ Consumer Protection (Direct Selling) Rules, 2021
These Rules are the main legal framework that regulates direct selling in India. Key points include:
Prohibit pyramid schemes or money circulation schemes.
Every company must register and maintain records of direct sellers (names, contact info).
The company must enter into a written contract with direct sellers.
No misrepresentation of earnings, products, or business opportunity.
Responsible for consumer grievances — companies must provide ways to file complaints.
Must maintain records and share them when needed for dispute resolution.
📌 Direct Selling Guidelines 2016
Defined important terms like Direct Selling Entity, Direct Seller, and Network of Direct Selling.
Set out ethical norms and prohibits deceptive or coercive practices. Indian Kanoon
📌 Consumer Protection Act & Authority
The Consumer Protection Act, 2019 supports direct selling rules and gives teeth to enforcement via the Central Consumer Protection Authority (CCPA). Wikipedia
📌 State Level Guidelines
Several states have also issued their own direct selling or MLM regulations — e.g., Maharashtra, Rajasthan, Tamil Nadu — but after the 2021 Rules, the national framework is primary. ADSEI
📌 No Central “Approved Company” List
The government no longer maintains an official list of approved direct selling companies (post-2019). Companies must self-register and comply with legal rules — there’s no single official list.
